Military advocate general reaches plea bargain in the most significant event mentioned in UN Goldstone Report; Givati soldier was accused of shooting women who raised white flag.

A soldier accused of killing two women who waved a white flag during the "Cast Lead" operation in Gaza reached a plea bargain with the military advocate general and will be jailed for 45 days. The agreement will be submitted today to the Jaffa military court, after negotiations between MAG and the soldier's attorneys. The soldier, Staff Sgt. S', from Givati Brigade will be convicted of a relatively light offense - illegal use of weapons.

The soldier's indictment is considered the most significant case handled by the MAG in relation to Operation Cast Lead. S' was originally accused of killing a woman and daughter whose names were mentioned in the UN Goldstone Report. Ria Abu Hajaj, 64, and her daughter Majda, 37, were killed as they were waving a white flag on the first day of the Israel Defense Force's ground operation in Gaza, on January 4, 2009.

The indictment was one of several indictments submitted by Maj. Gen. Avichai Mandelblit, former chief military advocate general following the accusations in the Goldstone Report concerning alleged war crimes committed by IDF soldiers.

At the time, IDF forces received warnings that an armed fighter hiding among fleeing women might try to shoot at soldiers. According to the evidence in the case, Staff Sgt. S' deliberately shot at a figure among the group of civilians, in contradiction to orders.

S' has long since completed his army service. His attorneys claimed that there was no proven connection between his shooting and the death of the two women, and that the two events occurred in different times. They further argued that indicting a soldier for the killing of an anonymous victim, when no body was found, is questionable, and that many other soldiers also opened fire in the said event.

An IDF spokesperson verified the details this morning, and added that, following an arbitration process in the case and "after examining all the evidence and circumstances, and following the military court's recommendation, both sides reached a plea bargain that would see the indictment corrected to illegal use of weapons."

The Goldstone Report is a 575-page report that accused Israeli forces and Palestinian militants of war crimes during their conflict in Gaza in the winter of 2008-2009. It was compiled by a UN-appointed delegation led by Judge Richard Goldstone, and sparked great controversy in Israel upon its release in 2009.

December 27th will mark the three year anniversary of Operation Cast Lead , wherein some 1,400 Palestinians were slaughtered in the besieged Gaza Strip by Israel. Between December 27th, 2008 and January 18th,2009, during Operation Cast Lead, Israel slaughtered 352 children in the Gaza Strip.

Defense for Children International confirms the deaths of five children caused indirectly by Operation Cast Lead: one baby born prematurely during a raid and unable to survive for long; three children killed by unexploded ordnance on 23 January; and one child who had undergone heart surgery a week before the offensive, was of weak constitution, and died in June unable to overcome health complications resulting from inhalation of white phosphorous fumes during Operation Cast Lead:

It’s as though a fire is burning in my body. It’s too much for me to bear. In spite of all the medicine they are giving me the pain is still so strong.
Sixteen-year-old Samia Salman Al-Manay’a, speaking to Amnesty International from a hospital bed 10 days after a white phosphorus shell landed on her house in the Jabalia refugee camp, northern Gaza on 10 January.

Children were not the only victims of Israel’s precision-killing:

Randa Salha, a 34-year-old mother of seven, was killed with four of her children – one-year old Roula, Baha al-Din, aged four, Rana, 12, and Diya’ al-Din, 14, when Israeli forces bombed her home in the Beit Lahia Housing Project (Mashru’a Beit Lahia) in the middle of the night on 9 January 2009. Randa’s 22-year-old sister Fatma was also killed in the attack.

Only women and children were in the house at the time: Randa and her seven children, her sister and her sister-in-law and her two children, who were staying there because they thought it would be safer than their own homes. Randa’s husband, Fayez Salha, an employee of UNRWA (the United Nations Relief and Works Agency for Palestine Refugees in the Near East), was at work.

The family was seemingly alerted when a missile hit the roof, a new practice by Israeli forces that came to be known during Operation “Cast Lead” as the “knock on the roof” procedure. This involves firing a “teaser missile”, seemingly containing little or no explosive, at the roof of a house in order to scare the inhabitants into fleeing their home. The building is then targeted a few minutes later with a large bomb launched from an F-16 aircraft.

Randa and Fayez’s two surviving daughters,10-year old Rouba and nine-year-old Rasha, told Amnesty International delegates that they and their mother, siblings, aunts and cousins had scrambled to get out of the house. They had run out first and so survived, while their mother, siblings and one aunt had only managed to get to the bottom of the stairs when the house was bombed Not only did Israeli Forces slaughter some 1,400 Palestinian en masse, they also invaded homes and graffitied ”Death to the Arabs”, “we came to annihilate kill you” and “a good Arab is a dead Arab” in Hebrew on the walls of homes, according to photographs taken by Amnesty International.

RESPONSE: The above quote is a wrong inference from a fiscal law in Shulchan Oruch, Choshen Mishpat 405.3, that relates to times when slavery was a standard and accepted practice across the world.

BLOGGER: Response is BS. Even during the time mentioned above, the quote of Talmud, which is supposed to be a holy book, should not be as it is.

CLAIM 02: "It is permitted to take the body and the life of a Gentile." Sepher ikkarim III c 25.


RESPONSE: This is a misquotation. Rabbi Yosef Albo (the author) was asked by a Christian thinker about seeming injustice of the laws of Judaism dealing with charging interest on a loan. (According to Deuteronomy 23:20 and 23:21, a Jew is not allowed to lend with interest to another Jew, but may do so to a Gentile).

R. Albo answers: The "Gentile" or "heathen" in the above passage refers to idolater, who refuses to keep seven Noahide laws. The laws are universal for all mankind: A) prohibition of idolatry, B) prohibition of blasphemy, C) prohibition of murder, D) prohibition of immorality and promiscuity, E) prohibition of theft, F) establishment of judicial system, G) prohibition of cruelty to animals.

Such a person, who does not respect other's rights, places himself apart from human community and therefore can expect to be treated according to his own rules. He is a threat to everyone around and hence if somebody kills him, that person is not charged. On the contrary, even according to non-Jewish philosophers in those days (14th and 15th century, Spain), as R Albo brings, such a person should be killed. So it is regarding money matters: the prohibition of taking interest, that applies to everybody, including a non-Jew who keeps the Noahide laws (as R. Albo mentions a few sentences earlier), do not apply to him.

Second, even if he is, but violates them all or part thereof, he does not deserve to be killed by someone. Third, one can not just kill someone who has a different belief. RESPONSE: This is from the Shulcan Aruch and applies to killing Jewish heretics. The following line in this passage is that this law does not apply to anyone non-Jewish and it is forbidden to harm any gentile. The Jewish heretics are people which are a potential cause of harm and trouble to the Jewish nation. The penalty is designed to demonstrate the severity with which heretical views were considered, rather than a practical penalty as such penalties were rarely imposed. E.S./David S. Maddison.

CASES OF SHAME: What is a rabbi?

The word "Rabbi" refers to one of the ancient scribes - supposedly a holy man - who participated in writing the "Talmud". In Arabic, which is a Semitic language and a cousin to Hebrew, the word is"Rabbanie", or "Rabbie", means a godly man. My question is, are they really godly? I strongly doubt that. Israel's new Ashkenazi chief rabbi case: JERUSALEM: Israel's new Ashkenazi chief rabbi is facing growing calls to step down amid allegations of misconduct. The allegations center on sexual harassment charges against Yona Metzger, as well as charges that he engaged in fraud and is not qualified for the post. Aides to Metzger have rejected the allegations as a smear campaign fueled by political rivals.

Metzger and his Sephardi counterpart, Rabbi Shlomo Amar, were elected as Israel's chief rabbis April 14 by a 150-member public committee. Since then, however,
opposition to Metzger has grown. In the latest development, a Tel Aviv accountant filed a petition Monday in the High Court of Justice challenging Metzger's appointment. It will be heard by a three-judge panel.


The petition claims that allegations of fraud and other improprieties involving Metzger were not fully investigated because of his 1998 pledge not to stand for chief rabbi of Tel Aviv. Metzger's spokesman, Roni Rimon, told the Israeli daily Ma'ariv that the petition was full of "lies, lies and more lies" produced by "professional slanderers.". Metzger had been accused of forging witnesses' signatures on marriage contracts and unlawfully demanding payment for performing weddings, the daily Ha'aretz reported. As a result of the allegations, Metzger's permit to serve as a chief rabbi of a major city was revoked. However, it was reinstated several months later after a hearing before three senior Israeli rabbis -- including Eliyahu Bakshi - Doron, a former Sephardi chief rabbi -- who accepted Metzger's explanations and his commitment to leave the Tel Aviv race, the paper said.

The petition also argues that the Metzger, 50, who previously was rabbi of north Tel Aviv, was not qualified to
fill the chief rabbi's duties as head of the country's rabbinic court system because he never had been a religious judge or rabbi of a major city. The
petition maintained that the elections committee for the chief rabbi was not adequately informed of the misconduct allegations against Metzger. In related development, Ma'ariv recently published what it said were sexual harassment allegations involving Metzger. Three weeks before Metzger's election as chief
rabbi, the paper reported, it learned of complaints from four adult men who
claimed Metzger had touched their arms, legs and chests and expressed admiration for their muscular physiques.


Park Avenue rabbi Case: A prominent Park Avenue rabbi had a mistress nearly half his age sign a bizarre cohabitation contract - promising she’d get liposuction, become better educated and continue their already hot-and-heavy sexual relationship in exchange for half his house, the woman claims in a bombshell lawsuit. Janet Pizzo says she had a seven-year affair with the married Metropolitan Synagogue Rabbi Joel Goor - which included recurring steamy sex in his rabbinical office while he lied to his wife about his whereabouts. But their courtship crumbled when she suspected him of having another girlfriend, and he’s since become vindictive. She even caught him on audio tape threatening to prance around their Bronxhome naked in front of her 17-year-old daughter.
